Purpose of the Job

Reporting to the Chief Governance Officer, the successful incumbent will be responsible to provide strategic leadership and direction to the Legal Services department and provide oversight to the management of RAF attorney’s in line with the strategic objectives of the organisation as determined by the Board of the RAF.

Duties & Responsibilities

Strategy Development and Operational Planning
▪ Lead the Implementation of the Legal Services business strategy and plan that ensure alignment with short-term and long-term objectives.
▪ Lead the implementation and annual review of the overall Strategic Plan for the Legal Services department.
▪ Provide strategic input into the plan of the current and future interventions necessary to achieve acceptable levels and standards of the RAF strategy and operational plans to the Executive forum.

Policy Management
▪ Provide direction on the planning, development and implementation of policy, procedures and processes.
▪ Provide strategic direction to the Policy department on legislative compliance, emerging issues, risks and the implementation of changes required on policy matters.
▪ Prepare motivations to the Board for approval, for referral to the Minister regarding new provisions or amendment of existing provisions.
▪ Prepare motivations to the CEO for submissions to other national government departments and other bodies pertaining to new provisions or amendment provisions of other legislations.

Regulatory Management
▪ Advise business on compliance obligations.
▪ Oversee and lead the submission by the business on statutory reports.
▪ Report to the Risk Committee.

Contracts Management
▪ Lead and direct the management, monitoring and reporting on contracts and other agreements drafted/ vetted by the contract section.
▪ Negotiate, draft/ vet memorandums of understanding and other agreements.
▪ Lead and direct the drafting of contracts to accompany bid specifications.
▪ Ensure draft and vet procurement and/or other commercial contracts processes are effectively executed in the business unit.

Litigation Management
▪ Development and implementation of the overall litigation strategy of the organisation.
▪ Assess the litigation risk and advice on litigation strategy.
▪ Institute and defend litigation actions for and against the RAF.
▪ Provide oversight to the management of referred claims litigation.
▪ Manage service providers providing legal services to the Litigation Unit and the organisation as a whole
▪ Instruct and consult with external legal service providers.

Legal Advisory
▪ Manage, monitor and report on legal advice provided by the Legal Advice section.
▪ Manage, monitor and report on legal advice provided to the Board, Executive Management and business units.
▪ Instruct Attorney to brief counsel on legal opinion.
▪ Consult with the Attorney and Counsel where appropriate.
▪ Oversee and lead the conduct of legal research.
▪ Oversee the management of the state attorney function.
▪ Collaborate with the Training Department on specific training requirements and the development of training material.

Stakeholder Managament
▪ Prepare motivations to the Board for approval, for referral to the Minister regarding new provisions or amendment of existing provisions.
▪ Prepare motivations to the CEO for submissions to other national government departments and other bodies pertaining to new provisions or amendment provisions of other legislations.
▪ Facilitate communication with all levels of stakeholder in relation with Legal Services.
▪ Ensure adequate representation of the Fund in relevant external legal related activities

Financial Management
▪ Provide strategic input into annual planning and budget development to support strategic operational goals.
▪ Develop and implement RAF operational Legal Services budget.
▪ Ensure sufficient internal control measures are implemented for adherence to PFMA, RAF and other relevant legislation and regulation.
▪ Manage, monitor and control the department expenses budget.

People Management
▪ Ensure the sourcing, development and retention of a high-performance team.
▪ Lead and manage staff in the department to ensure that they achieve their objectives in line with the strategic objectives of the RAF.
▪ Oversee the implementation of human capital processes and procedures to control/regulate workplace conflict and/or institute corrective measures and consultation processes to address deviations from standards.

▪ Report quarterly on progress with implementation of operational plans.
▪ Lead the development of functional reporting systems, for management, project or performance reporting.
▪ Lead and direct the development of reports/ policies/ procedures and guide the process through the alignment of these documents to the overall RAF’s Strategy.

Desired Experience & Qualification

  • Four (4) year Bachelor’s Degree in Law or Legal related qualification.
  • Post graduate qualification in Law or Legal related qualification.
  • Admission as an Advocate or Attorney.
  • Corporate Council Association of South Africa (CCASA) Membership will be an added advantage.
  • Post graduate qualification in Business Management or Administration will be an added advantage.
  • Relevant 10 – 12 years’ experience in Corporate Legal/ Legal Advisory of which 5 years must have been on senior management level.
  • Experience in Constitutional Law and Administrative Law will be an added advantage.
  • At least 5 years appropriate post qualification litigation/ advisory experience.
  • Proven contract drafting, vetting and negotiation experience.
  • Proven legal Advice experience.

  • PFMA, PAIA, PAJA and other relevant legislation.

Package & Remuneration

Total cost to company applicable to this position is minimum R1 827 182.00 per annum, negotiable.

NB: “RAF offers Total Employment Cost packages with no additional contributions from the Employer, successful candidates are required to structure their packages in a manner that will suit their needs”.
